On Friday, Marquise Byrd, of Warren, Mich., succumbed to injuries sustained on December 19, when the teenagers allegedly dropped a construction sandbag from an overpass onto an interstate in OH, the Toledo Police Department said.
The sandbag, thrown from an overpass, went through the windshield and struck passenger Marquise Byrd, 22.

Olender said it was unlikely any of the four teenagers would be tried as adults; OH state laws don't allow for 13-year-olds to be tried this way and the children lacked significant criminal records, she said. "I think this windshield might have smacked his head".
He was rushed to a Toledo area hospital with severe head injuries, but could not be saved, CBS News reported.
The prosecutor's office says it doesn't plan to try the 13, 14, and 15-year old suspects as adults. On Dec. 20, they were charged with felonious assault in juvenile court.

A 13-year-old and three 14-year-olds were arraigned on charges of murder and vehicular vandalism in Lucas County Juvenile Court, according to Lori Olender, deputy chief of the juvenile division in the county prosecutor's office.

The four teenagers were observed leaving the overpass near the incident after the vehicle was struck, police said.
